Membership and Competition Participation Privacy Notice

This Privacy Notice (“Privacy Notice”) has been prepared to inform you regarding the processing of your personal data by Aydın Doğan Foundation (“Foundation”), acting as the data controller, in accordance with the Personal Data Protection Law No. 6698 (“Law”) and the applicable legislation.

2. Purposes and Legal Basis for Processing Personal Data

Your personal data is processed for the purposes of carrying out electronically the membership, application, evaluation and competition processes relating to the competition organized by the Foundation.

In this context, your personal data may particularly be processed for the purposes of creating your user account on the Competition website and carrying out membership procedures, enabling you to log into and manage your user account, keeping your membership information up to date, receiving your application to the Competition and creating your application record, identifying participants, verifying whether you meet the conditions for participation in the Competition, recording the information, documents and works submitted as part of your application and associating them with your application, monitoring your application process, identifying incomplete or inaccurate applications and contacting you where necessary for their completion, receiving, recording and classifying the works submitted to the Competition and preparing them for evaluation, submitting the works for jury evaluation, carrying out evaluation and selection processes, determining the Competition results and maintaining records thereof, identifying participants who have been ranked or are entitled to receive an award, communicating with participants regarding the application, evaluation, results and award processes of the Competition, providing necessary information and announcements, carrying out award and ranking processes, planning and carrying out exhibitions, events, organizations and similar activities relating to the Competition, receiving and responding to requests, questions, applications and complaints that may arise in connection with the Competition, carrying out the legal, administrative and operational processes of the Competition and the Foundation, fulfilling obligations arising from applicable legislation, establishing, exercising and protecting the Foundation's rights in the event of potential disputes, and ensuring information and system security.

In addition, if you choose to upload a photograph to your profile/application, your photograph may be processed for the purposes of creating your profile and/or Competition application, managing your participant information within the scope of the Competition processes, and carrying out award, exhibition, catalogue, announcement and promotional processes. Uploading a photograph is optional and is not required to complete your membership or application to the Competition.

The personal data that may be processed within the scope of the Competition, together with the relevant data categories, data types, purposes of processing and legal grounds for processing, are set out in the table below.

The relevant provisions of the Law corresponding to the legal bases specified in the table are as follows:

  • Article 5/2(c) of the Law: Processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract.
  • Article 5/2(ç) of the Law: It is necessary for compliance with a legal obligation to which the data controller is subject.
  • Article 5/2(e) of the Law: Data processing is necessary for the establishment, exercise or protection of any right.
  • Article 5/2(f) of the Law: Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

Information Regarding the Résumé/CV Field:  If you provide your résumé/CV within the scope of the Competition, please provide only information that is necessary and relevant to the Competition processes.

The Foundation does not request that you provide any special categories of personal data for the purposes of your participation in the Competition. Please do not provide health data, religious beliefs, political opinions, association/foundation/trade union membership information or any other information that may constitute special categories of personal data under Article 6 of the Law in your résumé/CV or in any other free-text fields available within the scope of the Competition.

3. Recipients of Personal Data and Purposes of Transfer

Your personal data collected within the scope of the Competition may be transferred to the following categories of recipients, to the extent necessary for and limited to the purposes specified above, in accordance with the conditions set forth under Articles 8 and 9 of the Law.

Identity, Contact and Competition/Application Data: Your personal data may be transferred to the Competition jury, service providers and suppliers supporting the conduct of the Competition, organization and event service providers, service providers providing infrastructure, storage or server services, and software providers facilitating the conduct of relevant processes, for the purposes of organizing the Competition, receiving and managing applications, evaluating the works submitted to the Competition, determining the results, carrying out award, exhibition and organization processes, and creating memberships in connection with such processes.

Visual and Audio Records: If you choose to provide a photograph, your photograph may be transferred to the relevant service providers for the purposes of carrying out Competition and participant profile processes, and conducting catalogue, exhibition, award ceremony, promotional and announcement activities.

Transaction Security Data: Your personal data may be transferred to the information technology, software, hosting, server and information security service providers engaged by the Foundation for the purposes of ensuring the security of the website and information systems, operating the technical infrastructure, and carrying out storage and hosting activities.

In addition, your personal data may be transferred to competent public institutions and organizations and judicial and administrative authorities for the purposes of fulfilling the Foundation's legal obligations, establishing, exercising or protecting the Foundation's legal rights, and responding to lawful requests from competent authorities.

Transfers of Personal Data Abroad: Since the servers of the e-mail service provider used for carrying out the Competition processes and communicating with participants are located abroad, your contact data may be transferred abroad where your explicit consent has been obtained, in accordance with the conditions set forth under Article 9 of the Law.

In addition, for the purpose of exhibiting the works submitted by you within the scope of your participation in the Competition at various festivals, exhibitions or conferences held in Türkiye and/or abroad, your personal data associated with such works may be transferred to the institutions and organizations organizing the relevant events. Where such transfers abroad are occasional in nature, your personal data may be transferred abroad, subject to your explicit consent, in accordance with the conditions set forth under Article 9 of the Law.

4. Methods of Collection of Personal Data

Your personal data is collected through:

  • the user account and membership forms you create on the Competition website,
  • the application forms you complete for participation in the Competition,
  • the works, documents and other content you upload to the system within the scope of the Competition,
  • the photograph you may optionally upload to the system,
  • e-mails and other electronic communications with the Foundation; and
  • electronic records and logs generated during your use of the website and your user account

in electronic form, by wholly or partly automated means.

5. Requests to the Data Controller and Your Rights

You may submit your requests regarding your personal data pursuant to Article 11 of the Law to the Foundation at any time, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, in writing or by using a registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the e-mail address previously notified by you to the Foundation and registered in the Foundation's systems.
